beijing higher people’s court dismissed panasonic’s appeal, fujian super tech advanced material co., ltd. won the patent infringement dispute.
on january 14, 2014, panasonic corporation (hereafter "panasonic" for short) filed a civil lawsuit against fujian super tech advanced material co., ltd. (hereafter “supertech ” for short) to the shanghai first intermediate people's court, suing that the " vacuum insulation panel" produced by supertech was infringing its patent no. 819446.7, whose invention title was 【heat insulation box and vacuum heat insulation material used therefor】
on march 10, 2014, super tech submitted a "request for invalidation" to china sipo patent reexamination committee, stating that panasonic's patent no. 819446.7 claims 17 to 25 does not possess the novelty or inventiveness and not in conformity with the relevant provisions of the patent law, the above claims should be invalidated. on july 18, 2014, china sipo patent reexamination committee made decision no. 23427th, that patent no. 819446.7 claims 17-25 by panasonic, were invalid.
after that, panasonic put forward the application to withdraw the prosecution against super techl from shanghai first intermediate people's court.
on october 31, 2014, panasonic brought a suit in the beijing first intermediate people's court, requesting for revocation of no. 23427th invalidation review decision made by sipo patent reexamination committee and confirming its invention patent no. 819446.7 claims 17-25 all valid. supertech was sued as the third party. on march 18, 2016, beijing first intermediate people's court made the administrative decision of no. 569th (2015) and dismissed the appeal by panasonic.
on april 15, 2016, panasonic brought a suit in beijing higher people's court, requesting revocation of the beijing first intermediate people's court (2015) no. 569th administrative judgment, revocation of no. 23427th invalidation review decision made by sipo patent reexamination committee. supertech attended the litigation as the third party. on may 8, 2017, beijing higher people's court made (2016) no. 2904 final administrative decision , dismissed panasonic’s appeal, upheld the original judgment. this judgment is final.
the case, which lasted for three years and four months, ended with the triumph of super tech . in the meantime, supertech withstood tremendous pressure, through unremitting efforts and practical work, defended its own rights, meanwhile safeguarded the dignity of chinese enterprises.
